Wednesday was the first time in history such a high ranking member of congress has ever been indicted. And the opposition party has done nothing to capitalize on this.

Why? Why in God’s name is the Democratic party completely AWOL from the entire media discussion of this issue?

I think it’s because the Democrats simply do not understand the media, and have been completely clueless about how to play the press since President Clinton left office. Democrats simply believe that we still exist in an environment where someone can simply be left out in the press, to be savaged by the actual facts. Wrong.

That is simply not how the media works today, and I don’t know how many times I have to say it. The way the media works today is that the press simply sits there in the middle, dumb and oblivious and pliable. For Democrats to be effective, they must have a presence in the media beyond a press release.

One argument I’ve heard is that Dems don’t want the indictment to be labeled “partisan”. Are you seriously kidding me? Do you think not having Democrats on-air is going to stop that? We’ve allowed DeLay to already begin framing this issue as poor widdle Tom DeLay persecuted by the mean Democrat Ronny Earle. Simply being invisible is enabling DeLay’s framing. Mass America doesn’t have any context for Tom DeLay, they have no idea who he is, and if they don’t hear any voice from the opposition, why wouldn’t they accept how he’s framed the issue? Simply because the print journalists will provide context for the story will not affect how it plays out. We are in a broadcast world, and not having a Democrat on the air on CNN, MSNBC, and Fox is dealing America a bad hand.

Some hints

  • He is District Attorney Ronny Earle, who has prosecuted more Democrats than Republicans
  • Earle has been re-elected numerous times by the people of Texas
  • DeLay was indicted by a grand jury in the state of Texas, made up of regular American citizens

Stop worrying about being partisan. This is political corruption, not a hot button liberal/conservative issue like abortion, taxes, etc. Any damn Democrat can make the case that the Republican party embodies a Culture of Corruption that is making life harder for American citizens - from the mismanagement of FEMA to the indictment of Tom DeLay and the insider trading of Bill Frist, it’s clear now to America what happens when you vote for Republicans.

This is the case Democrats have to make. Nobody else will do it. They won’t have “enough rope to hang themselves”. The Kerry campaign used the same logic and lost to an awol teetotaler who led America into an unpopular war, simply because they refused to use the press. 2006 will be another 2002 or worse if the Dems keep this up.

UPDATE: If I don’t see the Tom DeLay mugshot on every screen in America I’m giving up.

A Democratic aide said that Democrats were going to step back from the story to keep the heat on DeLay.

 We re just going to let the press run with this. Usually we have trouble getting the press to cover issues of corruption in Congress. In this case, that s not a problem, the aide said.

Losers. Losers. Losers.

    Two schools of thought within the Democratic Party vie for the hearts and minds of those who will be determining the platform not only in 2008, but Mid terms as well.

    One is considred the ‘radical’ left; a definitioin badly needed, but will stipulate for now, radical suffices.

    The other is made up of those who have a ‘wait and see’ philosohy. They may be called ‘moderates’ with no argument here.

    In the discussion here the ‘waits’ are betting the Republican Party in its defiant response to events, similar to Blunt rapidly succeding DeLay, will ultimately lead to the downfall of the Republican Party by virtue of it’s own sodden weight.

    The radicals see how that approach has worked in the distant past (Iran Contra) and more recently (swift boats) and concluded that the American Public is not convinced by virtue of the course of natural events.

    Those’natural’ events would be ‘good triumphs over evil’ and the easy recognition of how things work out in the end.

    No, the radicals know that rust never sleeps, and for the Democratic Party, the solution is the same for them as it is for the Republicans.

    Appeal to your base!

    That’s where the energy, vitality and passion resides.

    That is what convinces the public that you are the latest ‘go to guy’

    They want a doer. Not a watcher.

    They want people with conviction. They want people who dispense crap.

    They don’t take it, and they certainly won’t eat it.

    I’ve read the indictment, and I’m sure the Democrats have as well. DeLay will not be found guilty of anything.

    Maybe the Democrats have started to look before they leap and finally refuse to be burned like they have been repeatedly in the past. What happens to the image of Democrats who act like DeLay is guilty when the case against him is dismissed by a court?

    Although I’m sure Oliver doesn’t care if DeLay is actually guilty. He wants to pound the issue now before DeLay’s case is dropped.

    I am glad that you’ve read the case so thoroughly. I did as well. So did the members of the Grand Jury who felt that there was enough evidence to take the case to trial.

    If you are just here to try to say that DeLay is being framed, let me just say that this is not the first time the Hammer has found his way into ethical hot water - surely we don’t need to run down his numerous violations. As Democrats, we should have been harping on this for years. If we had, people would have had context into which to place this latest ethical “transgression.”

    By sitting on our hands, as we’ve been doing now for the better part of five years, we are essentially ceding the airwaves to the Right. We are saying that we are unable to stand up. For a party that has essentially lived on the sweat and toil of the working class for the last 30 years, this seems to me to be political suicide.

    We are not talking about the micropolitics of DeLay. The issue is the MacroPolitics of Republican policy and the lack of coherence and consitent vocal leadership from the DLC.

    David Brooks has a column in this morning’s NYT trashing Delay. This means that the Rovians have fingered Delay as another fall guy to take attention away from whitehouse failures. If we make a huge stink about Delay we’re playing into their strategy.

    Still…sometimes you do want to run the ball right at their big nose tackle.

    I keep hearing the refrain “Earle is a Democrat” as if that explained why he was prosecuting Delay. No DA would initiate such a public attack on one of the most powerful Republican politicians (particularly in a red state like Texas) unless he were absolutely sure of the politician’s guilt. In this case, Dems should be pointing out how many of Delay’s associates have been indicted instead of remaining silent.

    I totally agree with you that the Democrats are laying down — IF, that is, they haven’t even been trying to get on the cable networks to talk about DeLay. It does seem to me that with DeLay going on pretty much everywhere he can that the Repunks were in high gear, with a lot of the anchors helping them out. What I would like to know is whether Dean, Pelosi, Reid et al aren’t trying to get on or if they haven’t been able to GET on.

    Even though Dear Leader is wounded, DeLay represents the real ruthless power core of the Repunks, and it would not surprise me to find out some serious string-pulling is taking place to ice the Democrats here.

    I’m not saying you’re wrong. I just want some clarification.

    This indictment is a ham sandwich without the ham. Delay has been embarrassed, so people like Oliver and Kos got what they wanted, style over substance.

    I don’t know, Oliver. Sometimes the nastiest thing you can do is just let the other guy keep on doing what they do without comment. The meanest thing I ever saw a publication do was publish a letter to the editor complaining about the “liberal media” with all the grammar and spelling mistakes intact. Perhaps the meanest thing that can be done to this administration would be to just let them keep digging themselves a deeper and deeper hole.

    It’s still just over two years until the next election and the hole made by the administration and its cronies just keeps getting bigger and more members keep falling in. I have the feeling that their biggest screw-up either hasn’t been made or hasn’t been found out yet.

    Surest way to play into DeLay’s hand that this is a partisan smear campaign is to, well, turn it into a partisan smear campaign. Your passion for politics isn’t shared by most people in America and if they turn on the TV and see GOPers defending DeLay against tough and serious questions from the press (rather than attacks from the Dems), the impact is much greater politically.

    When your opponent is shooting himself in the foot, give him more bullets… Don’t grab the gun out of his hand and pull the trigger for him.

    Dems are smart to let him twist in the wind. (Frankly, I’m glad that Tom “The Federal Budget is Lean already” Delay is stepping down from leadership… it’s a shame that it’s cause is likely a political plus for the Dems.)

    Charley : Earle is probably just as sure of this case as he was each time he got indictments of Sen. Hutchinson. His track record of prosecution could lead one to suspect personal or political motivations being involved.

    z adura : Are you actually serious in stating that the Democrats should have been harping on DeLay for years, as though they have not been?

    If DeLay is convicted of the crime, he should be punished accordingly, within the legal system. The political ramifications are up to the voters, but if he is convicted, I would hope he would be man enough to vacate his seat.

    I am sure that he would be indicted with no evidence of wrong doing. I mean, it’s probably just a mix up. Maybe the hammer left his drivers liscence at some strip joint and a lousey democrat found it. He then planted it on another democrat who pretended he was good ol’ boy Tommy and proceeded to do whatever ILLEGAL ACTIVITY HE HAS BEEN INDICTED for(I will admit I don’t know the specific’s)

    What’s going on here is the same thing that happened to MADD (Mothers Against Drunk Driving) long ago. So many of the legislators drove drunk, and so often got away with it, that they were’nt about to toughen up the laws in that area.

    A similar circumstance applies here: So many politicians are corrupt, in so many ways, that they’re afraid to point fingers.

    Teddy Feces : Usually, that would be true. However, this prosecutor has shown a willingness to indict people only to later have the case thrown out by the Judge because the prosecutor was unwilling or unable to present a case in court, ie. Earle’s indictment of Sen. Kaye Bailey Hutchinson.

    What I see is that corporations are prohibited from giving directly to campaigns in Texas. They can give for parties, but only for administrative and operational costs (such as the light bill) and for expenses to pay for primaries and elections.

    Delay circumvented this law by conspiring to launder money from his Pac through the RNC back to state candidates directly. Which is exactly what the indictment says, as presented on the Smoking Gun website.

    I know that’s not what Hannity said, but when you read the document, the truth is pretty clear.

    There is no explanation about what DeLay supossedly did personally, which is why I was interested in what you thought was so clear.

    As far as the rest of the indictment, it says that 6 corporations, Colandro, and Ellis violated Chapters 253.003, 253.094, and 253.104 of the Texas Election Code.

    If you bother to look at the code, it says that corporations can’t give to political parties within 60 days of an election. The description in the indictment says that the PAC, which had earlier received money from the corporations, donated to the RNC within 60 days. This is called a “soft-money shuffle” which both parties in all 50 states perform.

    If you can show how the indictment indicates this is illegal under Texas law, and how DeLay is involved…I’m interested.

    with stipulations that the money be contributed directly to candidates

    Potentially illegal depending on the circumstances, hence the indictment against Colyandro and Ellis who are specifically linked to the activity.

    The indictment lays out the scenario as
    1) 6 corporations give a total of $155,000 to Colyandro (member of DeLay’s PAC)
    2) Ellis (member of DeLay’s PAC) gives $190,000 (made out to the RNSEC) and a list of Republican candidates’ names to RNC

    See you re very lazy- you stopped at the  60 days part.

    Because that what the indictment pointed to within the Texas Election Law. It had nothing to do with being lazy. What other violation is mentioned within the chapter sections referenced in the indictment?

    JD: Loopy is echoing Dem talking points (I’ve seen them before): Rice is unqualified because a) She’s never been elected to anything before (actually, that comes under the heading of “unlikely to win”, not unqualified (I’m sure there are people out there who have never been elected to anything, but are more than qualified to be President, e.g., CEO’s of major corporations, distinguished Poli Sci Professors, etc.). However, in Secretary Rice’s case, that sword cuts both ways — she has never cut deals, kissed ass, or taken bribes to stay in office.

    Maybe you should become a lawyer, or maybe you already are one. In my experience, I have never found two lawyers who have agreed on the interpretation of any legal document, so I find it telling that you would all find the same arcane interpretation.

    I have no idea if my facts are the same as what those two are saying since I work all day long. I don’t have cable so I don’t watch FoxNews at night.

    My guess is that I have the amazing ability to read which I’ve put to use by actually looking at the indictment. What have I pointed out that is in error?

    BTW, I couldn’t care less about DeLay. I am a Libertarian who hates the big government policies of the current Republicans. But I also believe the truth is more important than partisan advantage. Enjoy the indictment while it lasts, because it’s not going to put DeLay in prison.

    Let’s see… President Roosevelt, the greatest president we’ve ever had, was the victim of a surprise attack. He didn’t have a memo on his desk saying “Hey, you might want to do something about these guys who are going to fly planes into buildings”. He also reacted to said attack by killing Nazis and the Japanese who were actually attacking us. Oh, he also destroyed a Republican-created Depression while he was at it.

    And picking Patrick Ruffini’s fairy tale straw poll as indicative of national Republicans is even more idiotic than people thinking Daily Kos readers are an accurate representation of who the Dem candidate will be (no, I don’t think Dennis Kucinich has a chance). The party of “we don’t want no queers to get married and that John Kerry shure talks funny” is not about to pick a black woman to be anything resembling the president. Think of it this way, you’ll have more than enough fodder for your Condi fan fiction for some time to come.

    I sincerely hope that Condi gets the con nomination in ‘08, I really do. It will guarantee a Democratic landslide. I’ll even donate money to her primary campaign, if she has a real chance of winning.

    But she doesn’t. You can crochet sweaters saying I heart Condi all you want, you can cut/paste Condi articles on your blog to your hearts content (even though you are breaking copyright laws) it doesn’t change the fact that Republicans don’t put black Republicans in office.

    But you were the one who implied that conservative Republicans wouldn’t support Rice. I would suggest (correctly) that if even conservative Republicans will support her (e.g., “Rice takes vote from Giuliani”), then certainly moderates will. You just don’t want to see it, because if a black person makes it to the White House, you want it to be your black person — like Barack Obama.

    Why you couldn’t possibly accept her as President is beyond me, but then I don’t know why you despise Bush, either.

    I don’t really know what makes me a bigot, Frankie, other than thinking a black woman who was the National Security Advisor when we had the biggest National Security Failure in our history is unqualified.

    I think my Italian butcher is unqualified for president, I guess that means I’m anti-Italian. He cuts a mean steak though.

    I also find that cons tend to blame others for their own faults. And considering your comments on another blog during your hiatus calling some black people “savages”, I don’t think you have the moral authority to call anyone racist.

    I don’t put my real name on my posts mostly because I want to keep my private life seperate from my blog life. I have seen too many cases where kooks stalk and harass people, sometimes causing them to lose their jobs and more, based on something they say on a blog. Have you ever considered the fact that libertarians agree with liberals on the vast majority of social issues?     My comment is directed at the large contingent of “libertarians” who nonetheless agree with 99.9% of what the Republicans say, and vote Republican in elections.

    I see cons doing this all the time, running to the defense of their heros, and then when someone points the finger of partisanship at them they say “Who, me? No, I’m a libertarian”. I’m just looking for some intellectual honesty. If you agree with 99.9% of Bush’s policies, you are not a libertarian. You are a Con Republican.
