Not even a state like Nebraska requires the Democrats to have a senator so conservative that he won’t vote for Elena Kagan. At this point, after all his moaning and whining over issue after issue to whittle things down to his right-leaning whims, Ben Nelson is just doing Repulican work. His term isn’t up until 2012, but Democrats in Nebraska need to find a replacement.

Keep it up guys. Because the minority vote isn’t 100% Democratic, you seem to be doing your part to get it there.

Looks like Senate Judiciary Republicans have at least one unified talking point today: Justice Thurgood Marshall, the first African-American to ever serve on the Supreme Court, was an ‘activist judge.’ As Elena Kagan kept on her listening face, multiple senators slammed both Marshall’s judicial philosophy and her service as his clerk in the late 1980s.

Ranking member Sen. Jeff Sessions (R-AL) criticized Kagan for having ‘associated herself with well-known activist judges who have used their power to redefine the meaning of our constitution and have the result of advancing that judge’s preferred social policies,’ citing Marshall as his son, Thurgood Marshall Jr., sat in the audience of the Judiciary Committee hearings.

Robert Bork To Oppose Elena Kagan, Will Boost Pro-Choice Support For Kagan

I think the White House ought to send old Bork a thank you note. Whatever concerns pro-choice folks have about Kagan should continue to evaporate.

Failed conservative Supreme Court nominee Robert Bork is joining anti-abortion activists to publicly oppose confirming Elena Kagan as a justice.

Bork plans to detail his criticisms of Kagan during a Wednesday news conference organized by Americans United for Life. The group calls itself the country’s first national pro-life organization, and brands Kagan a pro-abortion activist.

Elena Kagan, Harry ReidThere was some noise made on the right about the documents not being released, and I remember remarking that when they were released, there wouldn’t be much there. Of course there isn’t. Look, especially in the modern era there just isn’t ever going to be that Perry Mason moment when a document is uncovered supposedly exposing the deep dark secret of a Supreme Court nominee. I’m not a big fan of the kabuki theater in the process, and I especially don’t like how conservative nominees are given far greater latitude to admit to their ideology, but it is what it is.
