Ideology Nation

This NY Times story discusses how Supreme Court clerkships are getting more ideological on either side of the court, following the pattern forged in the House of Representatives and the Senate. About now, the only people in Washington who are still accommodating the others are Senate Dems and President Obama.

Time to wake up, guys. The war’s on.

    I agree that this is dangerous, but am willing to suggest it might not be *quite* so bad as one might think. In 2008 I hear Prof. Lawrence Lessig (Stanford Law prof., Net Neutrality and copyright reform advocate) speak at Netroots Nation in Austin, and he surprisingly recounted how he had clerked for Scalia. He did remark about always being surrounded by this majority of troglodyte far right-wingers, but at least he was given a shot. Now maybe he was that year’s “token liberal” for Scalia (which the article mentions) but since it also says Scalia only takes clerks from Republican-appointed lower court judges, this suggests that at least some of those lower Republican judges are at least willing to give some posts to smart, articulate liberals.

  3. I hate it hate it hate it how all of these institutions which were created to allow us to co-operate to our mutual benefit are now nothing more than battlegrounds for intertribal warfare.

    That said, I want our tribe to win.
