A federal judge in Philadelphia last night threw out a complaint by a Montgomery County lawyer who claimed that Democratic presidential candidate Barack Obama was not qualified to be president and that his name should be removed from the Nov. 4 ballot.
Philip J. Berg alleged in a complaint filed in federal district court on Aug. 21 against Obama, the Democratic National Committee and the Federal Election Commission, that Obama was born in Mombasa, Kenya.
Berg claimed that the Democratic presidential standardbearer is not even an American citizen but a citizen of Indonesia and therefore ineligible to be president.
He alleged that if Obama was permitted to run for president and subsequently found to be ineligible, he and other voters would be disenfranchised.
U.S. District Judge R. Barclay Surrick had denied Berg’s request for a temporary restraining order on Aug. 22 but had not ruled on the merits of the suit until yesterday.

In a 34-page memorandum and opinion, the judge said Berg’s allegations of harm were “too vague and too attenuated” to confer standing on him or any other voters.
Surrick ruled that Berg’s attempts to use certain laws to gain standing to pursue his claim that Obama was not a natural-born citizen were “frivolous and not worthy of discussion.”
The judge also said the harm Berg alleged did “not constitute an injury in fact” and Berg’s arguments to the contrary “ventured into the unreasonable.”

I know it’s academically considered good judicial minimalism to throw out a lawsuit on threshold matters like standing rather than addressing the merits if one can avoid going to the merits, but the wingnuts are not going to be even slightly appeased by having a lawsuit like this tossed on what they consider a ‘technicality.’ I wish the judge had gone ahead and said, “Not only do you not have standing, but your claims are factually ridiculous.”

The Obama document is a Certification of Live Birth. This is not to be confused with the longer Certificate of Live Birth that has the hospital name and doctor/witnesses signature. If Obama was born in Hawaii, they have a filed copy of the longer Certificate of Live Birth. They do not normally give that out because it takes longer to find/copy and certify that than it does to print a Certification of Live Birth from archived data. Most places will take the Certification of Live Birth as all the documentation they need. You can get your longer Certificate of Live Birth (in spite of the miss information on “Factcheck.org” that there is nor box to request it.) In the box for “reason,” you write for Depart. of Homeland Security. They want the longer version because the shorter one does not contain enough data. Obama has failed to do this. Why? He has 600 million in campaign funds donated to him. Money can not be an object. An additional note is- you could have gotten a shorter Certification of Live Birth in Hawaii in the early 1960’s even if you were not born there. It was a service they provided for people who lived in Hawaii for at least one year before the birth (as I understand it.) That is why the Department of Homeland security does not want the short version. They have to spend a lot of time investigating the other details to verify you are actually who you claim to be.
If any tools still want to blather on about Obama’s birth certificate, then you would have to argue with the following dupes who have accepted his lack of legal credentials to run as president;

3) Hawaii’s policy is ONLY to give out the computer-generated CLB’s; they do not make and distribute copies of the original hospital certificate. If this bothers you, complain to THEM, not Obama.

Note: WHO IS ONE YEAR OLD OR OLDER. So, how do you respond to that. Are you saying that the Cert of Birth is a Late Registration, and do you have expert sources (not some flake on the internet) to assert that, or are you saying that the child registered as being born in Aug 1961 was actually born at a different date, and do you have expert sources (not some flake on internet) to assert that.
This whole thing has to be one of the stupidest things (and I do, as a rather expert genealogist, and one-time law school attendee, but career specialist in “burden of proof” and “legal procedures and pleadings”, waste my own time on this trying to hammer some sense into folks’ thick heads.
