Right wingers love to shoot off their mouths with exactly zero evidence. It’s not just opining, as all of us do, its pretending to talk like an expert about stuff you don’t remotely understand. We saw that in the Jill Carroll case, when they were ready to lynch – literally – a woman who was an Iraqi prisoner. I don’t know what the hell happened in this case at Duke University, but this much is clear: two people have been indicted and arrested. Who knows where it goes from there, but I’m wondering if the mouths who were shooting off last week might think twice now.

Puzzling. With no DNA evidence, will it be he said/she said without any corroborative evidence. Will the defense be allowed to bring up the alleged victim’s past?
I figure DA must have other, corroborated independent evidence or he would not have moved forward. But, due to the lack of DNA, I bet they walk.

Almost certainly not. Rape shield laws.
DNA is good evidence, but it’s not the only way to convict someone. Not all cases are episodes of CSI, although many juries expect it…an increasingly troubling problem.

That’s an odd charge for this site to make. If you go back through the archives, you’d find loads of spilled glee about DeLay and Libby’s all-but-inevitable convictions and about how Joe WIlson was a hero.

I agree, the women was probably assaulted, the question becomes who actually assaulted her.
It will interesting to see whether there was evidence that suggest that there SHOULD be DNA i.e. spermatazoa. If there is, and the DNA didn’t match any of the players? Get out of jail card….

If this young woman was “repeatedly” assaulted by several Duke lacrosse players, then authorities should have found plentiful DNA evidence on her body (semen, sweat, skin, hair, etc.) left by the attackers.
The DA says that there was physical evidence of an assault. I have no doubt that this is true.
But if they can’t match DNA from the players to anything recovered from her body, then it is most likely probable that none of the players were responsible for that assault.
I’m not clear about the extent of the DNA analysis results released by attorneys for the players, but the assumption seems to be that none of the 46 white players’ DNA matched samples taken from the victim.
If that is the case, then there will be no conviction.
Actually Farris (and others) Jeralyn is making an analysis based on what actually has been reported. She also happens to be a lawyer. Furthermore, there’s no problem with opining based on the facts at hand (what I do, constantly). It’s the jumping to conclusions to the point where people like Barber are calling the alleged rape “fake”. DeLay and Libby are guilty of being horrible filthy human beings, any legal problems they have is just icing on the cake.
Maybe I don’t understand the definition of “fabricated.” Please enlighten me.
It’s interesting that this became a right wing issue- this is a simple rape case that got too much play in the national media.
It is a sad situation. Who knows what really happened. But the RW blog-worlds eagerness to exonerate the (white) boys and vilify the (black) (alleged) victim really shows you why they are so hopped up about this case.

Actually it was first a left wing issue down here. The ‘outrage’ line was a rape of a black person wasn’t big news. Then it kind of morphed into a thing about how neat it was that blacks were being completely bypassed in the investigation in favor of whites (reversal). Is there now a Tawana Brawley morph coming up?

The main issue in this case is that it’s been totally bastardized by the media, and the media licks up whatever lawyers tell them. The DNA was reported by the defense attorneys. Media took it and ran with it and now the public thinks that this girl is a lying whore.
I also want to reiterate that people are convicted of rape without DNA evidence. This isn’t SCI. People need to stop pretending that they know all of the facts. It’s not even clear to the court — how are we so certain about what’s going on?
It makes no sense to have any certain belief about this case regarding the truth of the facts asserted. If you think this girl is a lying whore, you’re probably just getting played by the defense’s lawyers and the media that eats up every piece of information they get as objective. It’s not. It’s like talking to a player’s agent about how many home runs he’s going to hit next season. It’s not news. It’s not objective. They have an agenda.
Gotta be wise to this stuff.
What is there to think twice about? The “escort” claims to have been sexually assaulted in nearly every way imagineable and yet there is not a shred of DNA evidence. Time stampted photos show the alleged victim arriving at the party already brusied and cut up. The security guard at Kroger’s believes she was on something as she wouldn’t get out of the other “escort’s” car. Apparently, the two players charged were ID’d solely by photograph and nothing else. And now, it turns out, one of the players indicted had already left in a taxi and gone to an ATM machine at the time of the alleged assault. The story doesn’t add up and is not helped by an overzealous prosecutor who has backed himself into a corner.
Hedley, thank you for repeating everything that the defense attorneys has told to the media. Lawyers, when speaking with the media, are even less objective than the most political of pundits. That is their job. Something to think about.
I wish the public would stop pretending that they have the facts of the case, when really the majority of the information out there is from the defense.
And for the last time, DNA is not a requisite for a rape conviction.
Lawyers aren’t objective? Wow. Really? You mean they are advocating for their clients? Who knew. You think maybe the prosecutors do the same thing before a grand jury or when pandering to a black audience with an election coming up?
Regardless, the defense attorneys have done more than just recite their story to the media, they have produced time-stamped photographs, witness statements and ATM records which the media has reported on. Those are facts. Not all the facts obviously, but facts nonetheless. And at the moment the facts as known throw the alleged victim’s accounti nto question and whether or not the right people were indicted if a rape did indeed take place.
Lastly, no one is saying that you can’t have a rape without DNA, but the absence of DNA is, at minimum, curious. It’s kind of like a defendant who doesn’t take the stand. Of course he doesn’t have to, but it doesn’t look too good if he doesn’t.

You are right that there could be rape w/o DNA but -I’m gonna say it- this whole thing is starting to look fishy to me. First, no DNA. Now one of the indictees has evidently a rock solid alibi – and yet he was indicted.
I smell an ambitious prosecutor – up for re-election.

I just find it rather curious that anyone can have a hard-and-fast opinion on the matter. Not just this case, but any bastardized media case. I’m not advocating any one side, just pointing out that this case is being packaged and sold.
Hedley, I tend to agree with you (sans the condecending first paragraph, of course), but the fact remains that the questions you raise (“throw the alleged victim s accounti nto question and whether or not the right people were indicted if a rape did indeed take place.”) are questions for a jury.
Again, I’m not advocating a specific position, just advocating normal judicial process. I don’t think it makes much sense at this point to be adament about one side or the other.

um….it’s not been right-wingers that have had these kids convicted and sentenced already.
it’s the idiot left-wing activists hodling vigils and rallies in front of the home of the kids before there was any evidence presented at all.
btw, getting indicted involves no presentation of defense evidence, and if you’ve been paying attention, one kid is already pretty much off the hook. Don’t know much about the Finnerty kid, but we’ll see.
This stripper has a checkered past as well. These are all things to take into consideration before you try to make this a right/left issue, or god forbid, a black/white one, which it will inevitably will be anyways. The race pimps have much to gain by pitting people against one another.
