Hurricane Katrina is expected to cause a spurt of bankruptcy filings by storm victims — and sweeping changes in U.S. bankruptcy laws may leave them even more strapped than they otherwise might be.
The Bankruptcy Abuse Prevention and Consumer Protection Act, which takes effect Oct. 17, includes a slew of rules and restrictions intended to curb abuse. These are expected to make it harder for individuals to file to keep creditors away, and more difficult for businesses to reorganize.
But the law wasn’t directed at people who file because of catastrophes such as Katrina, in which people lost homes, businesses and perhaps months of regular paychecks. Katrina has caused widespread devastation in Louisiana and Mississippi and left New Orleans, population 462,269, virtually uninhabitable.
“People who are seriously affected by this hurricane are not going to be able to file bankruptcy by October 17,” said Henry Sommer, co-editor of “Collier on Bankruptcy,” a leading reference work. “They have more pressing things in their lives, like survival.”
UPDATE: Via Lis, we see that the House Dems have legislation to exempt Katrina victims from this legislation. Anyone who votes against it is scum.
According to Atrios, several Democrats in the House plan to introduce a bill to exempt Katarina victims from the new law’s provisions.

OUr beloved fearless leader is not to blame for this storm. No..he is to blame for the fact that FEMA worked OKAY until he and the rest of his rumsfelds decided to fix things. These are the same people that couldnt plan the IRaq war. How in the hell did anyone think a disaster could be handled by these guys?
And on top of it, the pathetically incompetent Mary Landrieu was given an opportunity to speak about the slow response and dire conditions. I loved the look on Elizabeth Vargas face. She kept asking questions and Landrieu just went into a political speech as if Vargas wasnt even there. Is she the best her party could run in La.?
Ah, the Democrats…they have an opportunity to stand for something but they are going to fritter it away….go for the throat, you chicken shit cowards…the opposition is stumbling around on the ropes.
Privatize FEMA and HOmeland Security….Haliburton couldnt do any worse.
When I was a boy I remember watching tv when there was hurricane or a tornado or any other horrible event - but I remember that there was hero’s present - I know - that there still are, but it really - I know that they did show up…but boy - it just does not seem the same - we need to take our country back.
